Please read these Terms of Service ("Terms") carefully before using the Palate mobile application ("the App") operated by Anthony Eli Rasch - sapplify, PO Box 004, 91501 Nové Mesto nad Váhom, Slovakia ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Service Description
Palate is a personal food-feeling tracking application that allows you to:
- Log meals and food consumption
- Record self-assessed energy, mood, and digestion ratings
- View correlations between your dietary choices and how you feel
- Track logging consistency with a streak counter
The App stores all data locally on your device. We do not provide cloud storage, backup, or sync services in version 1.0.
2. Health Disclaimer
Palate is NOT a medical device, diagnostic tool, or substitute for professional medical advice.
- The correlations and insights generated by Palate are based solely on your self-reported data and simple statistical analysis. They are not medical diagnoses.
- Palate does not provide nutritional advice, dietary recommendations, or treatment plans.
- The App's insights should be treated as observations, not prescriptions. "You tend to feel less energetic after dairy" is an observation, not a diagnosis of lactose intolerance.
- Always consult a qualified healthcare professional before making significant dietary changes, especially if you have known food allergies, intolerances, or medical conditions.
- If you are experiencing a medical emergency, call your local emergency number immediately. Do not rely on Palate for health emergencies.
- Palate is not intended to diagnose, treat, cure, or prevent any disease or health condition.
3. Eligibility
You must be at least 13 years old to use the App. If you are under 18, you should review these Terms with a parent or guardian. By using the App, you represent that you meet these age requirements.
4. User Responsibilities
When using Palate, you agree to:
- Use the App for personal, non-commercial purposes only
- Not attempt to reverse-engineer, decompile, or disassemble the App
- Not use the App in any way that violates applicable laws or regulations
- Not attempt to access other users' data (not applicable in v1.0 as there are no multi-user features, but applies to future versions)
5. Your Data
- Ownership: You own all data you enter into Palate. We claim no ownership over your meals, feelings, notes, or any other content you create.
- Storage: All data is stored locally on your device in version 1.0. We do not have access to your data.
- Loss: Since data is stored only on your device, we cannot recover data that is lost due to device failure, app deletion, or any other cause. We recommend periodically exporting your data using the in-app export feature.
- Deletion: You can delete individual entries or all data at any time through the App. Uninstalling the App permanently deletes all associated data.
6. Subscription Terms
Palate Pro
Palate offers an optional premium subscription ("Palate Pro") with the following terms:
- Pricing: $6.99/month or $49.99/year (prices may vary by region and are subject to change)
- Free trial: If offered, the trial period and terms will be clearly disclosed before you subscribe
- Billing: Subscriptions are billed through Apple's App Store or Google Play Store. Payment is charged to your store account at confirmation of purchase
- Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
- Cancellation: You can cancel at any time through your device's subscription settings (Settings > Apple ID > Subscriptions on iOS, or Google Play Store > Subscriptions on Android). Cancellation takes effect at the end of the current billing period. You retain access to Pro features until then
- Refunds: Refund requests are handled by Apple or Google according to their respective refund policies
Free Tier
The free version of Palate provides core functionality including meal logging, feeling check-ins, timeline view, and basic insights. Some features may be limited or restricted to Pro subscribers.
7. Intellectual Property
- The Palate app, including its design, code, graphics, and content (excluding user-generated content), is our intellectual property
- "Palate" and the Palate logo are our trademarks
- You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal purposes in accordance with these Terms
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- The App is provided "as is" and "as available" without warranties of any kind, either express or implied
- We do not warrant that the App will be error-free, uninterrupted, or free of harmful components
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
- Our total liability for any claims related to the App shall not exceed the amount you paid for the App in the 12 months preceding the claim
- We are not liable for any health decisions made based on the App's insights or correlations
- We are not liable for data loss resulting from device failure, app deletion, or any other cause
9. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the App or violation of these Terms.
10. Changes to Terms
We may update these Terms from time to time. When we do:
- We will update the "Last updated" date
- We will notify you through an in-app notice
- For material changes, we will require your acceptance of the new Terms before continued use
- Your continued use of the App after receiving notice of changes constitutes acceptance of the updated Terms
11. Termination
- You may stop using the App at any time by uninstalling it
- We may terminate or suspend your access to the App if you violate these Terms
- Upon termination, all data stored on your device remains under your control
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
13. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in class actions.
Small claims exception: Either party may bring qualifying claims in small claims court.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
